Terms of business: Site Feasibility Screen
Last updated 27 October 2026.
These terms apply when you order a Site Feasibility Screen ("the Screen") from Upgrade Project Solutions Ltd, company number 15208992, registered office Suite 8, 5th Floor, St James House, Pendleton Way, Salford M6 5FW ("we", "us"). The order form sets out the site, scenario, fee and delivery date. If the order form and these terms conflict, the order form wins.
1. The service
The Screen is a desk-based review of one identifiable site, up to about 1 hectare, in one local planning authority area, for one stated scenario. It covers HM Land Registry records, relevant planning policy and history, and a constraints review of flood, heritage, ecology and biodiversity, access, contamination and infrastructure, where public records permit. It ends in a written verdict of proceed, investigate or pause, with reasons and recommended next steps.
We will carry out the Screen with reasonable care and skill.
2. What the Screen is not
The Screen is not planning permission, a pre-application response, legal advice, a title opinion, a boundary survey, a valuation or viability appraisal, or an environmental, ecological, ground or engineering survey. It is not a prediction or promise that planning permission will be granted. Planning decisions are made by the local planning authority.
3. Your responsibilities
- Give us accurate site details and tell us of anything you know that affects the site.
- Only share personal information about other people, such as landowners, if you are entitled to.
- Tell us promptly if the scenario changes. A change of scope may change the fee and timing, which we agree in writing.
4. Fees and payment
The fee is fixed and stated in the order form. For the pilot, the fee is £895, payable 50% when you place the order and 50% when we issue the report. Invoices are payable within 14 days. VAT is added only if we are VAT-registered at the invoice date. Third-party costs outside the Screen, such as specialist surveys or council fees, are not included and are agreed separately.
5. Timing and refund
Our target is to issue the report within five working days of receiving complete site details and your instruction. If we do not issue the report within ten working days of instruction, you may ask for a full refund of what you have paid, unless the delay comes from missing information or a change of scope.
6. Cancellation if you are a consumer
If you order as an individual for purposes outside your trade or business, and the contract is made without us meeting in person, you can cancel within 14 days of the day the contract is made by telling us clearly. If you ask us to start within those 14 days, you must pay for the work done up to the time you cancel. If we complete the Screen within the 14 days at your express request, and you acknowledged that you would then lose the right to cancel, the right to cancel ends when the report is delivered.
7. Use of the report
The report is for you, for the purpose stated in the order form. No one else may rely on it unless we agree in writing. We keep the copyright in the report and give you a licence to use and copy it for that purpose.
8. Our liability
If you are a business, our total liability to you arising from the Screen, whether in contract, negligence or otherwise, is limited to the fee you paid for it. We are not liable for loss of profit, loss of opportunity, or indirect or consequential loss. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law. If you are a consumer, your statutory rights are not affected.
9. Information and confidentiality
We keep your information confidential and use it as described in our privacy notice. We may share it with professional advisers who help us deliver or check the work, under confidentiality.
10. Complaints
Please tell us if something goes wrong. Our complaints procedure explains how.
11. Law
These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, except that a consumer living elsewhere in the UK may also bring proceedings in their home courts.
